Recent Supreme Court, NGT orders to cut vehicular pollution

New Delhi: In the past few months, the Supreme Court and National Green Tribunal (NGT) have issued a series of directives to tackle air pollution. According to a study released by Delhi-based environmental think-tank Centre for Science and Environment on 15 December 2015, air pollution claims at least 10,000-30,000 lives a year in Delhi. It is one of the top 10 killers in the world and the fifth leading cause of death in India, said the study titled Body Burden 2015: State of India’s Health.

The Supreme Court levies a green tax, or environment compensation charge, ofRs.700 on light commercial vehicles and Rs.1,300 on trucks entering the city limits.

16 December 2015

The Supreme Court bans sale of high-end diesel passenger vehicles (engine capacity of 2000cc and above) till 31 March and makes it mandatory for taxis in Delhi-NCR to shift to CNG fuel. It also doubles entry tax on trucks into the city and takes 10-year-old diesel powered commercial vehicles off the city’s roads.

The Supreme Court bars heavy commercial vehicles from entering Delhi from national highways 2 (Delhi-Kolkata), 10 (Punjab-Delhi) and 58 (Uttarakhand-Ghaziabad-Delhi) as well as state highway 57 (Baghpat-Ghaziabad-Delhi). It also asks the government how soon it could implement Bharat Standard (BS) VI emission norms, bypassing BS V. The government says it had planned on making BS IV applicable nationwide by 2017, BS V by 2019 and BS VI by 2020-21.

The court also asks the centre to consider phasing out diesel cars more than 10 years old. The centre agrees and adds that cars that were BS III compliant would be considered for retrofitting with newer and cleaner technology. The apex court also observes that it is considering extending the ban on the registration of diesel cars to those with engine capacities below 2,000 cc as well.

The NGT directs Volkswagen to give an undertaking by 11 January that it would not sell any vehicle in India fitted with a “cheat device”.
