Notice to BMC on shoddy waste disposal method

Acting upon a complaint filed by the MP Pollution Control Board, Chief Judicial Magistrate Anil Kumar Gupta slapped a show cause notice on a Bhopal Municipal Corporation assistant engineer for failing to comply with Governmental regulations while disposing of solid waste at the Bhanpura landfill site.

The court directed assistant engineer NC Saxena to appear in the court on March 4 and explain why action should not be taken against him for 'disposing waste at the Bhanpura trenching ground in a manner that was hazardous for nearby (sic) residents' failing which proceedings against him would be conducted in absentia.

The notice comes in the wake of a complaint filed by the State PCB in which it had accused the corporation of neglecting to adhere to Municipal Solid Waste (Management and Handling) Rules 2000 norms while collecting, segregating, storing, transporting, processing and disposing of solid waste.

The BMC commissioner, chief engineer, health officer, assistant health officer and an assistant engineer had been named respondents by the PCB in its complaint filed under Section 15/16 of the Environment (Protection) Act, 1986. In its complaint the Board claimed to have come across evidence of waste being burned at the trenching ground which caused heavy air Pollution.

Separate notices were served on December 8, 2003 and February 5, 2004 to the corporation. The corporation not only failed to reply but continued to cause pollution due to its 'grossly negligent actions,' charged the board.
