Narmada pollution in MP: HC notice to Centre, state bodies

AHMEDABAD: The Gujarat high court on Wednesday issued a notice to various authorities, including central ministries, in response to a public interest litigation (PIL) seeking to stop the release of untreated sewage into Narmada river — considered Gujarat's lifeline — by eleven towns in Madhya Pradesh.

The petitioner, Kirtikumar Bhatt, who is an advocate, has cited an article published in The Times of India to highlight how the Narmada is being polluted in Madhya Pradesh, where the river travels through nearly 1,100km before entering Gujarat.

Bhatt has urged the high court to initiate legal proceedings against Madhya Pradesh and local authorities which release sewage into the Narmada. He wants action for causing severe pollution. He has sought action against the Madhya Pradesh Pollution Control Board for failing to stop the release of untreated sewage into the river. He has demanded measures to stop pollution of the river to avoid health hazards in Gujarat.

The petitioner submitted that the Narmada travels through 14 districts and 11 major towns of Madhya Pradesh. He said that almost all of these towns release untreated sewage directly into the river. Incidentally, the Madhya Pradesh Pollution Control Board has filed cases against 18 municipal bodies located within 10km of the Narmada river.

The PIL states that there are sufficient laws to control pollution, but the implementing authority does not take action against the polluters. It says that all central laws have force in Madhya Pradesh and therefore it is the duty of the Centre as well as of the Central Pollution Control Board (CPCB) and the state of Madhya Pradesh to ensure that pollution of Narmada is stopped immediately. After hearing the case, the high court issued a notice to the department of water resources department, the Government of Gujarat; the Gujarat Pollution Control Board; the Union ministry of drinking water & sanitation; the Union ministry of environment, forests & climate change; and the CPCB. The court has sought a reply by next month.
