NGT call to ban parking of cars on all tarred roads in capital

NEW DELHI: The National Green Tribunal on Monday ruled that parking of cars on tarred roads be prohibited completely and directed corporations to impose a fine of Rs 1,000 on violators as "compensation for degradation of environment". NGT was hearing a petition by lawyer and activist VardhamanKaushik against high air pollution levels in cities. It had ordered a ban on all vehicles more than 15 years old in the same case.

On Monday, the bench headed by NGT chairperson Swatanter Kumar said, "It will be ensured that stagnation of vehicles and traffic congestion are avoided, particularly by prohibiting parking on main roads or any other parking area on the metalled roads." It directed the corporation to submit a report on compliance with the order in Lajpat Nagar and Karol Bagh which are being considered 'pilot projects'.

Counsel for corporation and Delhi Police, Balendu Shekhar, Pooja Kalra and D R Rao, requested the bench that the ban on parking on tarred roads be limited to main roads and not bylanes and colony lanes. "What will residents do if they are deprived of all parking space?" asked one of them. The bench directed the lawyers to file a separate application on the issue.

The Lajpat Nagar Trader Association also moved a miscellaneous application in which they have said the ban on parking on tarred roads will affect them and have "civil consequences". The Association submitted it has paid Rs 120 crore in 2006 to the corporation for constructing parking areas. The bench issued strict directions to corporations, DDA and Delhi government also to identify places in Lajpat Nagar where multi-level parking facilities can be constructed. The bench appointed 14 lawyers as local commissioners to monitor compliance of their directions on parking.

An expert committee formed by the bench earlier on monitoring air quality in NCR also submitted its findings on Monday. "It is clear that ambient air in NCR is highly polluted. Obviously it's dangerous to human health and environment. These statistics clearly show that drastic measures need to be taken," the bench said.

MoEF submitted that according to their inspections hot mixture plants that were asked to be taken off the roads by NGT are still being run by PWD at Vikas Marg and other areas. The bench issued a notice to the PWD chief engineer on the issue. It also asked the CMD of DTC for a report on why 186 DTC buses were found without valid pollution under control certificates.
