Give first 20% fly ash free: National Green Tribunal

NASHIK: The National Green Tribunal (NGT) Pune has instructed the thermal power station here to give the first 20% of the fly ash for free to brick kiln manufacturers last week, while hearing the application filed by Nashik Fly Ash Bricks Association.

The tribunal also directed that the brick kiln manufacturing units should be situated 100km from the power station.

The application was filed in October 2013 against the concerned government officials for flouting the norms set by Ministry of Environment and Forests (MoEF) regarding fly ash.

The application was heard by Justices V R Kingaonkar and Ajay Deshpande. The application was disposed of last week with instructions to the respondents to follow the MoEF norms.

"The court directed that as per the norms of the MoEF, the first 20 per cent of fly ash should be given to the brick kiln manufacturers for free and the remaining 80 per cent should be sold. Until now, only selling of fly ash was done through tender process," said Asim Sarode, lawyer of the applicants.

"Also, the brick kiln manufacturing units have been directed to be at a radius of around 100 km from the power unit generating the fly ash unit as brick manufacturing causes soil erosion, air pollution and wastage of water," he added.

The NGT directed that all norms should be brought into the public domain by the secretary of urban department, district collector and the Maharashtra Pollution Control Board (MPCB). Also, the MPCB and the MoEF should jointly inspect units producing fly ash and strictly implement all the norms, said Sarode.

"Since year 2000, the brick kiln manufacturers were not being given any fly ash and that is why we filed the application. Rather than using red bricks, only fly ash bricks should be used. They are sturdier than red bricks and can maintain the balance of the environment," said Sunil Mendhekar, president of the association.

The applicants said that with the direction of NGT, they hoped that proper utilisation of fly ash will be made keeping in mind all the environment norms.
