Why clean fuel is not supplied in State, asks court

The Jharkhand High Court in a PIL raising questions about air pollution sought to know from the Centre as to why clean fuel is not supplied in Jharkhand.

On Thursday, a PIL filed by Rajneesh Mishra raising serious questions about the state of the air pollution was heard in the Division Bench of Chie Justice Gyan Sudha Misra and Justice DK Sinha.

The petition brings to the notice of the court the pollution caused by generators and vehicles, particularly that caused by the three-wheelers, and reportedly more so by the Vikram model vehicles. Petitioner’s counsel Dilip Jerath also submitted that the Jharkhand State Pollution Control Board accepts that this sort of pollution exists in the City.

Jerath further alleged that these vehicles have been banned in certain other states and cities like Jaipur. This causes their sale at cheap prices and they are acquired by persons from here and use in Jharkhand causing pollution. The court orally observed that it is like a “dumping ground.”

After hearing the counsels, particularly Jerath, the court noted and dictated that in view of the affidavit by the State they are directed to come out with measures against the pollution problem. It also directed the Centre to reply as to why clean fuel should not be supplied in Jharkhand. The matter will now come after 3 weeks.

In another PIL filed by Dev Das Pal in which he has raised question regarding certain lands in Sahebganj and the Deputy Commissioner was meant to have as per an order of the court filed affidavit on Thursday, the court directed that the DC file his affidavit by Friday if not he will have to appear in court in person on Monday.

Manish Mishra, State counsel sought to get the DC off hook by submitting that the statement of facts have been received and he is in the process of filing it soon, however the court taking a stern view gave him time to get the same filed by 9 May.

In the PIL filed by Arun Kumar Mehta, and represented by NK Pandey, the court was however, relived that some action had been taken by the state. In this petition the issue was of the non supply of water supply in Padma and Sarai villages in Hazaribagh due to lack of transformers and other technical reasons since 1985 -86.

Rajiv Ranjan for the State informed that new transformers have been installed and the water supply has resumed. They have also repaired the leakages in the pipes through which water is supplied.

However, he said that to change or substitute the pipes which run for around 20 kms or so will take time and the state needs around 3 more months to do that.

The court in its order that it is fortunate that it is reported that the defunct tube wells have been repaired, and noting that the State has informed that another 3 month is required for more work, - allowed time till 7 July.

The State is expected to give an up date by then as to the work being undertaken.
