A bench headed by NGT chairperson Justice Swatanter Kumar sought a response from the ministry of environment and forests (MoEF), Delhi Pollution Control Committee (DPCC), Delhi Cantonment Board and Delhi government on the ban before the next date of hearing.

The tribunal was hearing a challenge brought by All India Plastic Industries Association (AIPIA) to a notification by the Delhi government, imposing a blanket ban on the usage of plastic bags.

On 23 October, 2012, the Delhi government had issued a notification banning the manufacture, sale, storage, usage and transport of plastic carry bags in the capital. It was to be enforced from 23 November, 2012.

The matter was initially brought before the Delhi high court which had stayed the notification and subsequently transferred the matter to be heard by the green tribunal as it was already hearing similar matters. The high court, while transferring the matter, had asked the Delhi government to not take any coercive steps against AIPIA for eight weeks.

The association had challenged the notification contending that it was null and void and ultra vires the Environment (Protection) Act, 1986. It was further submitted that it violates the fundamental rights of the petitioner.

The matter will be heard next on 13 February.
